Changes to the civil penalty to prevent illegal working

The government is making changes to the civil penalty scheme to encourage employers to fulfil their duty by making the correct checks on their employees to prevent illegal working in the UK.
The changes came into force on Friday 16 May 2014.

The key changes are as follows:

  • The maximum penalty for employing an illegal worker will increase from £10,000 to £20,000.
  • There are important changes to the way in which employers are required to undertake checks which are set out in the new guidance.
  • The aim of these changes is to make it easier for legitimate employers to conduct the necessary right to work checks and to ensure a tougher response to employers of illegal workers.
